COLORADO MEMBERS: YOUR RIGHT TO CANCEL
YOU, THE BUYER, MAY CANCEL THIS CONTRACT, WITHOUT ANY PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING THE DATE OF THIS CONTRACT, EXCLUDING SUNDAYS AND HOLIDAYS. This notice is required by Colorado law (C.R.S. § 6-1-731, the dating services contract statute, which is a different provision from § 6-1-731.5 governing our Colorado Safety Policy).
In short
- Right now, InviteTrip is free. Paid subscriptions are not yet switched on. This policy describes how they will work when they are, so nothing about billing arrives as a surprise.
- Subscriptions renew automatically. We tell you before they do.
- If you signed up online, you can cancel online, in one step, at any time. No phone calls, no emails, no retention gauntlet.
- Cancelling stops the next charge. You keep access until the end of the period you already paid for.
- In the EU and UK you have 14 days to change your mind, with a pro-rata deduction for what you used. In Colorado you have 3 business days. See sections 6 and 7.
- Bought through the App Store or Google Play? Those refunds go through Apple or Google, not us. See section 9.
1. Current status
InviteTrip is in its founding phase. Paid subscriptions are not currently active, and no member is being charged. This policy is published in advance so that the terms are known before billing begins, and so that anyone assessing the platform can see them.
When billing goes live we will announce it, and no existing member will be charged without first choosing a paid plan.
2. What you can buy
Subscriptions. Recurring plans, billed monthly or annually, giving access to additional features. The plans, what each includes, and the price are shown before you buy.
Roses. A one-off gesture you can send to another member. Each plan includes a monthly allowance, and additional roses may be bought in packs. Roses are a consumable digital item. Section 8 explains how they are treated.
3. Before you buy
Before we take payment we show you, clearly and together, in a way you have to see rather than seek out: the price; the billing frequency; that the subscription renews automatically until cancelled; the date of the first renewal; and how to cancel.
We ask for your separate, affirmative agreement to the automatic renewal terms, distinct from your agreement to the purchase itself. We keep a record of that agreement.
We will not take payment without your express informed consent, and we do not use design that obscures the terms, pre-ticks a consent box, or makes the cheaper option hard to find.
4. Automatic renewal, and the notices we send
Subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel.
We send:
- A renewal reminder for any subscription with a term of one year or longer, between 15 and 45 days before it renews, stating the renewal date, the term, the price, and how to cancel.
- An annual reminder for continuous monthly subscriptions, stating what you are subscribed to, the price, and how to cancel.
- A trial conversion notice where a free or promotional period lasts longer than 31 days, sent between 3 and 21 days before the first paid charge.
- A price change notice, at least 7 and no more than 30 days before any increased charge takes effect. A price increase never applies to a period you have already paid for. Where the law of your state or country requires your affirmative consent to a price increase, we will ask for it, and if you do not give it, the subscription ends at the close of the current period rather than renewing at the new price.
5. How to cancel
If you subscribed online, you can cancel online, and that is all you have to do.
Open your profile and select Subscriptions & Roses. Near the top of that page, under Your membership, select Cancel membership. One confirmation screen tells you what you keep and until when, and that is the whole of it. It takes effect immediately for renewal purposes: no further charge is made. The cancel option is displayed directly and remains visible at all times. If we offer you an alternative, such as a pause or a different plan, the direct cancel option stays on screen next to it, and you never have to decline an offer to reach it.
You do not need to call us, email us, explain yourself, or complete a survey.
You may also cancel by writing to billing@invitetrip.com from the address on your account.
Effect of cancelling. You keep access to paid features until the end of the billing period you have already paid for. After that the account reverts to the free plan. Cancelling a subscription does not delete your account. To delete your account, write to info@invitetrip.com; there is no self-service delete control in the product yet.
Subscriptions bought through Apple or Google must be cancelled in the App Store or Google Play, because that is where the billing relationship sits. See section 9.
6. European Economic Area and United Kingdom: your right of withdrawal
If you are a consumer resident in the EEA or the UK, you have 14 days from the conclusion of the contract to withdraw from it, without giving a reason.
Immediate access. Because a subscription is only useful if it works straight away, we ask at checkout for your express request that we begin providing the service immediately, during the 14-day period, and for your acknowledgment of what that means for a refund. We confirm this to you by email, which is your durable record of it.
What you get back if you withdraw. If you withdraw within the 14 days after asking us to start immediately, you pay a proportionate amount for the part of the subscription period already supplied, calculated against the full price of the period, and we refund the rest. If you withdraw before we have begun providing the service, you get a full refund.
If we failed to give you the required information about your right of withdrawal, or failed to obtain your express request, you owe nothing for the period supplied.
How to withdraw. Tell us in a clear statement, by email to billing@invitetrip.com or by post to the address in the Legal Notice. You may use the model withdrawal form from the Consumer Rights Directive, but you do not have to. Cancelling from your account settings within the 14-day window also counts, and we will treat it as a withdrawal and refund you accordingly.
Refund timing. Within 14 days of receiving your withdrawal, by the same means you paid, at no cost to you.
Roses are treated differently. See section 8.
7. Other jurisdictions
Colorado. The notice at the top of this page applies. You may cancel a dating service contract without penalty or obligation at any time before midnight on the third business day after the date of the contract, excluding Sundays and holidays, and receive a full refund. Email billing@invitetrip.com. This right is in addition to everything else in this policy.
California and other US states with automatic renewal laws. The disclosure, consent, cancellation, and notice practices in sections 3, 4, and 5 are designed to meet the strictest of these requirements, and we apply them to every member wherever they live rather than varying them by state.
Switzerland. Swiss law does not provide a general cooling-off right for contracts concluded online, so sections 6 does not apply to Swiss members as a matter of Swiss law. Everything else in this policy does, including cancellation at any time under section 5, the notices in section 4, and the discretionary refunds in section 8.
Everywhere else. Sections 1 to 5 and 8 to 11 apply. Any mandatory consumer right under your own national law applies in addition, and this policy does not reduce it.
8. Refunds
Outside a statutory withdrawal or cancellation right, subscription fees are generally not refunded for a period that has already begun. You keep access for the rest of it.
We will refund, on request:
- Duplicate charges, and charges made after a valid cancellation.
- Charges resulting from a technical fault on our side.
- A subscription period during which the Service was substantially unavailable.
- A charge you did not authorize, once we have looked into it.
We will also consider a refund where a paid feature did not work as described, where you were charged shortly after a renewal you had not noticed and have not used the paid features since, or where your circumstances warrant it. Write to us and explain. We would rather refund a member who has a fair point than argue about it.
Where we terminate your account for a serious breach of the Terms, in particular anything in section 6 of the Terms of Service, no refund is due for the unused period except where the law requires one.
Roses and other one-off purchases. Roses are supplied immediately on purchase. Where you are an EEA or UK consumer, we ask you at the point of purchase to consent to immediate supply and to acknowledge that this ends your right of withdrawal for that purchase, as the Consumer Rights Directive permits. Unused roses are not refundable, do not expire while your account is open, and have no cash value. Roses already sent cannot be recovered, whether or not the recipient responds. Roses are lost when an account is deleted.
How to request a refund. Email billing@invitetrip.com from the address on your account, with the date and amount. We aim to respond within 5 business days and to process an approved refund within 14 days, to the original payment method.
9. Purchases made through Apple or Google
Apple App Store. Apple bills the transaction and handles refunds. We cannot issue a refund for an App Store purchase, and we cannot cancel an App Store subscription for you. Request a refund at reportaproblem.apple.com or through Settings on your device, and manage or cancel the subscription in your Apple account settings. Apple decides.
Your statutory rights are unaffected by which store processed the payment. If you are an EEA or UK consumer, the right of withdrawal in section 6 applies to a subscription bought through the App Store exactly as it does to one bought on our website. If Apple declines a refund you believe you are legally entitled to, write to billing@invitetrip.com and we will deal with it directly.
Google Play. Google bills the transaction. Some refunds are handled by Google directly and some are routed to us. Start at play.google.com under your subscriptions, or write to us and we will help. Members in the EEA and the UK keep the statutory withdrawal rights in section 6 for subscription purchases made through Google Play.
Purchases made directly on our website are governed by this policy in full, and we handle them ourselves.
10. Chargebacks
If you think a charge is wrong, please contact us before asking your bank to reverse it. We can usually resolve it faster. A chargeback raised without contacting us may result in the account being suspended while the dispute is open.
