Terms of Service

In short

This page is the agreement between you and InviteTrip Inc. The essentials:

• You must be 18 or older. There are no exceptions.
• InviteTrip is a platform for meeting people and traveling together. It is not an escort service and not a marketplace for paid companionship of any kind. Offering or asking for money, gifts, or travel in exchange for sexual conduct gets an account removed permanently.
• Neither role is expected to pay for the other. Where one member does pay for part or all of a trip, that is hospitality between two adults: it is not payment for company, and it obligates the other member to nothing.
• No money moves between members through InviteTrip, and we do not permit members to arrange payments to each other in connection with the platform.
• We verify identity documents. We do not run criminal background checks. Verification tells you a person is who their ID says they are. It tells you nothing about whether they are safe.
• You can report or block anyone, at any time, and a person reviews every report.
• If you are in the US, disputes are resolved by individual arbitration and you give up the right to a class action. If you live in the EU, the UK, or Switzerland, the consumer protections your own country gives you still apply, whatever this page says.

1. Who we are and what this agreement covers

1.1 InviteTrip is operated by InviteTrip Inc., a corporation organized under the laws of the State of Delaware, United States ("InviteTrip", "we", "us", "our"). Our contact and postal details appear in the Legal Notice.

1.2 These Terms of Service ("Terms") govern your access to and use of the InviteTrip websites, applications, and services (together, the "Service"). They form a binding contract between you and InviteTrip Inc.

1.3 The following documents are incorporated into these Terms by reference and apply to you as if set out here in full: the Privacy Policy, the Consumer Health Data Privacy Policy, the Cookie Policy, the Community Guidelines, the Safety Policy, and the Refund and Cancellation Policy.

The Safety Policy is published as the Safety Center at /safety. The two names refer to the same document. Members resident in Colorado are additionally covered by the Colorado Safety Policy.

1.4 By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

2. Changes to these Terms

2.1 We may change these Terms. When we do, we will post the revised version with a new version number and effective date.

2.2 Where a change is material and affects your rights or obligations, we will give you notice through the Service or by email before it takes effect, and the notice will explain what is changing. For members in the European Union, this notice is given in accordance with Article 14 of Regulation (EU) 2022/2065 (the Digital Services Act).

2.3 If you do not accept a change, your remedy is to stop using the Service and close your account before the change takes effect. Continued use after the effective date means you accept the revised Terms.

3. Eligibility

3.1 You must be at least 18 years old. This is an absolute condition of using the Service. There is no version of the Service available to minors, and we do not knowingly permit anyone under 18 to hold an account.

3.2 By creating an account you represent that you are 18 or older, that you have the legal capacity to enter into this agreement, and that you are not barred from using the Service under any applicable law.

3.3 We may require you to verify your identity and age at any time, and we may suspend or terminate an account where we have a reasonable basis to believe the holder is under 18, pending verification. Where we conclude an account holder is a minor, we will close the account and delete the associated data.

3.4 You may not use the Service if you have previously been removed from it, if you are the subject of a sanctions designation that prohibits us from dealing with you, or if you are required to register as a sex offender in any jurisdiction.

3.5 The Service is offered worldwide, but it is not directed at every jurisdiction, and local law may restrict your use of it. You are responsible for ensuring your use is lawful where you are.

4. Your account

4.1 You must provide accurate information when you register and keep it current.

4.2 You are responsible for your account credentials and for activity that takes place under your account. Tell us promptly if you believe your account has been accessed without your permission.

4.3 One account per role. You may hold one account as an Inviter and, separately, one account as an Invitee, but you may not hold more than one account under the same role. If you hold an account under each role, contact us at info@invitetrip.com so we can note the connection between them for safety purposes; we do not automatically link or carry over verification between such accounts. You may not create an account on behalf of anyone else, sell or transfer an account, or create a new account after we have removed a previous one.

5. Identity verification, and what it does and does not mean

5.1 InviteTrip offers identity verification. A member who completes it submits a government-issued identity document and a live image or video, which are checked by a specialist verification provider. The check confirms that the document appears genuine and that the person presenting it is physically present and matches it.

5.2 Members who complete verification receive a "Verified" mark on their profile. Members who have not completed verification have restricted access to parts of the Service, and those restrictions may change over time.

5.3 A separate "Real" mark may appear on a profile. It means that a number of verified members of the opposite role have confirmed, independently and privately, that they met that person in real life and had no safety concerns. It is a statement by other members about their own past experience. It is not a statement by InviteTrip about anyone's character, intentions, or safety.

5.4 We do not conduct criminal background checks. This is set out in full, and in the form particular jurisdictions require, in the Safety Policy. Identity verification establishes that a person is who they claim to be. It does not establish that they are honest, trustworthy, or safe, and you should not treat it as if it did.

6. What InviteTrip is, and what it is not

This section defines the nature of the Service. It is a condition of using InviteTrip that you understand and accept it.

6.1 What the Service is. InviteTrip is a platform for social introductions and travel companionship between adults. Members create profiles, describe trips they are planning or would like to join, discover other members, communicate, and, if they choose, arrange to travel together.

6.2 The two roles. An "Inviter" is a member who plans a trip and may invite another member to share it. An "Invitee" is a member who may receive and accept such invitations. The roles describe who initiates travel plans. They do not describe a commercial relationship, a hierarchy, an exchange of anything for anything, or any obligation to pay. In particular, the Inviter role carries no obligation to pay for the other member's flights, accommodation, meals, or any other cost.

6.3 What the Service is not. InviteTrip is not an escort agency, an escort directory, or a marketplace for sexual services. It is not a venue for commercial companionship, for arrangements in which company or intimacy is provided in exchange for money or support, or for any other transactional relationship of that kind. It may not be used as one.

6.4 Travel costs are hospitality, not consideration. No member is obliged or expected to pay for another member. An Inviter is not expected to fund a trip, and how the costs of a shared trip are borne or divided is settled between the two members themselves: some members choose to pay for the other, some divide every cost evenly, and both are ordinary on InviteTrip. InviteTrip is not a party to that decision, to any discussion of it, or to any payment made under it, and any such payment is made directly to the provider of the flight, the accommodation, the meal, or the activity. Where one member does pay for flights, accommodation, meals, activities, or other costs of a shared trip, that expenditure is hospitality extended voluntarily between adults who have chosen to travel together. It is not payment for companionship, for intimacy, or for any other service. It purchases nothing, and it creates no entitlement of any kind in the person who paid it. A member who accepts an invitation, or who accepts such hospitality, owes nothing in return for it, and remains free at every moment to decline any activity, to change plans, to end a trip, and to leave. Both members are expected to act in good faith toward each other, as any two people making plans together would be, but that expectation arises from the arrangement itself and is not bought by, increased by, or in any way connected to what either of them spent.

6.5 No exchange of money between members. InviteTrip provides no mechanism by which one member can send money to another, and we do not permit members to solicit, offer, or arrange such transfers in connection with the Service. This includes cash, bank transfers, payment applications, cryptocurrency, gift cards, and equivalent instruments. Costs of a shared trip are paid by whichever member is paying them directly to the businesses providing those services, such as airlines, hotels, and restaurants, and never handed to another member as money or a money equivalent.

6.6 Prohibited absolutely. Soliciting, offering, advertising, or agreeing to any arrangement in which sexual conduct is exchanged for money, gifts, travel, accommodation, or anything else of value is prohibited without exception. So is any attempt to use the Service to recruit for, advertise, or facilitate commercial sexual activity, whether your own or another person's.

6.7 Consequences. An account used in breach of section 6.5 or 6.6 will be terminated permanently on discovery, without refund of any unused subscription period except where a refund is required by law. Where conduct appears to involve coercion, trafficking, exploitation, or the involvement of a minor, we will report it to the appropriate authorities and preserve the relevant records.

6.8 Consent. Engaging in sexual conduct with another person without that person's consent violates these Terms, violates the law, and may result in criminal or civil liability. Nothing that happens on InviteTrip, including accepting an invitation, accepting hospitality, or traveling together, constitutes consent to any sexual activity. Consent is specific, it is given by the person themselves, and it can be withdrawn at any time.

7. Conduct

7.1 The Community Guidelines set out in detail what is and is not acceptable on InviteTrip, and they form part of these Terms.

7.2 Without limiting them, you agree not to:

(a) harass, threaten, intimidate, stalk, defame, or abuse any person;

(b) impersonate any person, misrepresent your age, identity, appearance, circumstances, or intentions, or use images that are not of you;

(c) engage in any fraud or deception, including romance fraud, investment or cryptocurrency solicitation, phishing, and any scheme to obtain money or financial information from another member;

(d) post or transmit content that is unlawful, that sexualizes any minor, that depicts non-consensual sexual activity, that incites violence, or that attacks people on the basis of a protected characteristic;

(e) share another person's private or intimate images or personal information without their consent;

(f) use the Service for advertising, promotion, recruitment, or commercial solicitation of any kind;

(g) circumvent, disable, or interfere with security or safety features, including attempts to evade a removal by creating a new account;

(h) scrape, crawl, harvest, or otherwise collect data from the Service by automated means, or use the Service to train a machine learning model;

(i) interfere with the operation of the Service or attempt to gain unauthorized access to it or to any other member's account.

7.3 Conduct that threatens public or personal safety, including homicide, unlawful sexual behavior, assault, kidnapping, stalking, harassment, involuntary intoxication, robbery, and theft, is prohibited on the Service and in connection with any meeting arranged through it.

8. Content

8.1 You keep ownership of the content you submit.

8.2 You grant InviteTrip a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, and display your content for the purposes of operating, securing, and improving the Service, including displaying your profile to other members and processing content for the safety purposes described in the Privacy Policy. The license lasts as long as we host the content and for a reasonable period afterwards to the extent needed for backups, legal obligations, and the handling of reports.

8.3 We do not sell your content, and we do not use it to train machine learning models for our own or anyone else's benefit.

8.4 You are responsible for your content and you represent that you have the rights necessary to submit it.

8.5 We may remove content that breaches these Terms or the Community Guidelines, or where removal is required by law.

9. Safety features, and their limits

9.1 The Service includes safety features described in the Safety Policy, among them identity verification, reporting, blocking, unmatching, automated and human review of profile content and messages, and in-app video and voice calling.

9.2 These features reduce risk. They do not eliminate it. We cannot and do not guarantee the identity, honesty, intentions, conduct, criminal history, or safety of any member, and we do not screen members for criminal history at all.

9.3 You alone decide whether to communicate with, meet, or travel with another member. Meeting a person you met online carries real risk, and traveling to another city or country to do so carries more, because you may be far from anyone who could help you. The Safety Policy sets out precautions we strongly recommend. Please read it before you arrange to meet anyone.

9.4 InviteTrip is not a party to any arrangement between members, is not present at any meeting, and does not supervise, mediate, or take responsibility for what members do offline.

10. Reporting, moderation, and appeals

10.1 You can report a profile or an individual message from within the Service. Reports are confidential and the person reported is not told who reported them.

10.2 We review reports and may remove content, restrict features, suspend an account, or terminate it permanently. We take into account the seriousness of the conduct, its context, and any history on the account.

10.3 Where we restrict your content or your account, we will tell you what we did and why, unless the law prevents us or the account was created to evade a previous removal. For members in the European Union, this statement of reasons is provided in accordance with Article 17 of the Digital Services Act.

10.4 If you believe a decision was wrong, you may appeal by writing to appeals@invitetrip.com from the email address on your account. A person who was not responsible for the original decision will review it.

10.5 Where we become aware of information giving rise to a suspicion that a criminal offense involving a threat to the life or safety of a person has taken place, is taking place, or is likely to take place, we will inform the relevant law enforcement or judicial authorities.

11. Subscriptions and payment

11.1 InviteTrip is currently in its founding phase, and paid subscriptions are not yet active. No member is being charged. This section and the Refund and Cancellation Policy describe how paid plans will work when they are switched on, so that the terms are known in advance. We will announce it before billing begins, and no existing member will be charged without first choosing a paid plan.

11.1a When paid plans are active, parts of the Service will require a subscription. Prices, billing periods, and what each plan includes are shown before you buy.

11.2 Subscriptions renew automatically unless cancelled. The Refund and Cancellation Policy explains renewal, cancellation, refunds, your statutory withdrawal rights, and how purchases made through the Apple App Store or Google Play are handled. It forms part of these Terms.

11.3 We may change prices. A price change never applies to a billing period you have already paid for, and we will give you advance notice as required by the Refund and Cancellation Policy and by applicable law.

11.4 You are responsible for any taxes that apply to your purchase and that are not collected by us.

12. Intellectual property

12.1 The Service, including its software, design, text, graphics, and the InviteTrip name and marks, belongs to InviteTrip Inc. or its licensors and is protected by intellectual property law.

12.2 We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of it, except to the extent that restriction is unenforceable under applicable law.

13. Third-party services

The Service relies on third parties for functions including hosting, identity verification, video and voice calling, email delivery, payment processing, and automated safety review. It may also link to third-party websites. We are not responsible for third-party services or sites, and your use of them is governed by their own terms.

14. Suspension and termination

14.1 You may close your account at any time by writing to us at info@invitetrip.com. The Service does not yet include a self-service close or delete control; we action the request and confirm it to you.

14.2 We may suspend or terminate your access where you breach these Terms or the Community Guidelines, where we are required to by law, where it is necessary to protect members or the Service, or where we discontinue the Service.

14.3 Where we terminate for a serious breach, including any breach of section 6, no refund is due except where applicable law requires one.

14.4 Sections that by their nature should survive termination do so, including sections 8.2, 12, 15, 16, 17, 18, and 19.

15. Disclaimers

15.1 To the extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15.2 We do not warrant that the Service will be uninterrupted, error free, or secure, that any defect will be corrected, or that you will find a match, a travel companion, or any particular outcome.

15.3 Nothing in this section limits any warranty or guarantee that cannot be excluded under the law that applies to you. Consumers in the European Union, the United Kingdom, and Switzerland have statutory rights regarding the conformity of digital services which these Terms do not affect.

16. Limitation of liability

16.1 To the extent permitted by law, InviteTrip Inc. and its officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service.

16.2 To the extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars.

16.3 These limits do not apply to: liability for death or personal injury caused by our negligence; liability for fraud or fraudulent misrepresentation; liability for gross negligence or willful misconduct; or any other liability that cannot be excluded or limited under the law that applies to you. Consumers resident in the European Union, the United Kingdom, and Switzerland benefit from mandatory national rules that may give them greater rights than this section, and those rules prevail over it.

16.4 The allocation of risk in this section is a basis of the agreement between us, and it reflects what the Service is: a platform that introduces people to each other and hosts what they choose to say, not a party to anything they go on to do.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless InviteTrip Inc. and its officers, directors, employees, and agents from claims, damages, losses, liabilities, and reasonable legal costs arising out of your breach of these Terms, your misuse of the Service, your content, or your conduct toward another member, including offline conduct. This section does not apply to consumers to the extent applicable consumer protection law does not permit it.

18. Disputes

Please read this section carefully. For members in the United States it affects how claims must be brought.

18.1 Talk to us first

Most problems can be resolved quickly. Before starting formal proceedings, please contact us at the address in the Legal Notice with a description of the problem and what you would like us to do. We will try to resolve it within 30 days.

18.2 Members in the United States: arbitration and class action waiver

(a) If you reside in the United States, any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be settled by binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court.

(b) You and InviteTrip each waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

(c) Exceptions. This section does not apply to: claims that may be brought in small claims court; claims for injunctive relief concerning intellectual property; or any claim that applicable law does not permit to be arbitrated. Nothing in this section prevents you from reporting conduct to, or bringing a complaint before, any government agency or regulator.

(d) Your right to opt out. You may opt out of this arbitration agreement by writing to us at the address in the Legal Notice within 30 days of first accepting these Terms, stating your name, the email address on your account, and that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

(e) If subsection (b) is found unenforceable as to a particular claim, that claim will proceed in court and the remainder of this section 18.2 continues to apply to all other claims.

18.3 Members in the European Union, the United Kingdom, and Switzerland

(a) Section 18.2 does not apply to you.

(b) You may bring proceedings in the courts of the country where you are resident, and you have the benefit of the mandatory consumer protection rules of that country. Nothing in these Terms deprives you of the protection of provisions that cannot be derogated from by agreement under the law of your country of habitual residence.

(c) Alternative dispute resolution. InviteTrip is not currently committed to, and does not currently participate in, any alternative dispute resolution scheme before a consumer dispute resolution body. This statement is given in accordance with Article 13 of Directive 2013/11/EU. If this changes, we will name the body here and in this document. Your national European Consumer Centre can tell you what options are available to you locally.

19. Governing law

19.1 These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.

19.2 This choice of law does not deprive a consumer of the protection of the mandatory law of their country of habitual residence. If you are resident in the European Union, the United Kingdom, or Switzerland, the consumer protection rules of your country apply to you to the extent they cannot be excluded by agreement.

20. Contact and points of contact

20.1 General contact details are in the Legal Notice.

20.2 Electronic point of contact. Members and any other person may contact us electronically at the address given in the Legal Notice. This is also our single point of contact for communications from authorities of European Union Member States, the European Commission, and the European Board for Digital Services, under Articles 11 and 12 of the Digital Services Act. Communications may be sent in English or German.

21. General

21.1 Entire agreement. These Terms and the documents incorporated into them are the entire agreement between you and InviteTrip about the Service.

21.2 Severability. If a provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in force.

21.3 No waiver. Not enforcing a provision is not a waiver of it.

21.4 Assignment. You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets, on notice to you, provided your rights are not reduced.

21.5 Language. These Terms are written in English. Translations are provided for convenience. Where a translation conflicts with the English version, the English version governs, except where the law of your country of residence requires otherwise.
